How many smoky stores sell lottery tickets?

I'm open to other opinions, but here's something that seems to be ridiculous to me. A man is arguing that the federal Americans with Disabilities Act should protect him from having to buy tickets at smoky stores:

The issue has been smoldering since 2006, when Billy Williams, 77, of Lewisville complained to lottery officials that he suffered an asthma attack after buying a lottery ticket at a store in Whitney that allowed smoking.

The Americans with Disabilities Act is an important piece of legislation, but how many places in Lewisville sell lottery tickets and don't allow smoking? Isn't that like every gas station and grocery store?

It's not possible to make people to sell the lottery tickets in every gas station and grocery store.. People sell tickets as they earn wealth but you cannot prohibit each and every one to stop selling the lottery tickets...
